Legal mandate
With the aim of supporting national authorities carrying out coast guard functions at national and the Union level and, where appropriate, at international level, EFCA, EMSA and Frontex have established an inter-agency cooperation, in accordance with the Agencies’ respective mandates and with the financial rules applicable to those Agencies. The legal basis of this cooperation is described next:

Article 292 of the Treaty on the Functioning of the European Union, so that the European Commission may adopt the Recommendation (EU) 2021/1222 of 20/07/2021.

Regulation (EU) 2019/473 of the European Parliament and of the Council of 19 March 2019 on the European Fisheries Control Agency (EFCA), in particular Articles 3.j, 8.2 and 8.3 thereof.

Regulation (EC) 1406/2002 of the European Parliament and of the Council of 27 June 2002 establishing a European Maritime Safety Agency (EMSA), in particular Article 2b thereof.

Regulation (EU) 2019/1896 of the European Parliament and of the Council of 13 November 2019 on the European Border and Coast Guard and repealing Regulations (EU) No 1052/2013 and (EU) 2016/16243, in particular Article 69 thereof.

Tripartite Working Agreement (TWA) establishing the inter-agency cooperation framework, which entered into force in March 2017 and was extended in March 2021.
